1) Scope of Application
1.1 These Terms of Service (hereinafter "Terms") of Amble Hound, operating under "Amble Hound" (hereinafter "Seller"), apply to all contracts for the delivery of goods entered into by a consumer or business (hereinafter "Customer") with the Seller regarding the goods presented by the Seller in its online shop. The Customer's own terms and conditions shall not apply unless expressly agreed otherwise.
1.2 A consumer within the meaning of these Terms is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
1.3 A business within the meaning of these Terms is a natural or legal person, or a partnership with legal capacity, who, when entering into a legal transaction, acts in the exercise of their trade, business, or profession.

2) Conclusion of Contract
2.1 The product descriptions contained in the Seller's online shop do not constitute binding offers, but serve to enable the Customer to submit a binding offer.
2.2 The Customer may submit the offer via the Seller's online order form. By submitting the order, the Customer makes a binding offer to enter into a contract.
2.3 The Seller may accept the offer within five days by:

  • sending an order confirmation,
  • delivering the goods, or
  • requesting payment.

2.4 If payment is made via PayPal, acceptance of the offer occurs automatically upon clicking the "Order with obligation to pay" button.
2.5 The text of the contract is stored by the Seller and sent to the Customer by email after the contract has been concluded.
2.6 Before submitting the order, the Customer may review and, if necessary, correct all entries.
2.7 The language(s) available for concluding the contract are indicated in the online shop.
2.8 Order processing takes place via email. The Customer must ensure that the email address provided is correct.

3) Right of Withdrawal
3.1 Consumers are generally entitled to a right of withdrawal.
3.2 Further details can be found in the withdrawal instructions.
3.3 The right of withdrawal does not apply to consumers whose residence and delivery address are outside the EU.

4) Prices and Payment Terms
4.1 All prices are total prices.
4.2 For deliveries outside the EU, additional costs may apply (e.g., customs duties).
4.3 The available payment methods are listed in the online shop.
4.4 In the case of advance payment, payment is due immediately upon conclusion of the contract.
4.5 If "SOFORT" or "Shopify Payments" is selected, the terms of the respective payment service provider apply.
4.6 Further information on Stripe or Klarna is available on their respective websites.

5) Delivery and Shipping Terms
5.1 Delivery is made to the delivery address provided.
5.2 If delivery is delayed due to the Customer's fault, the Customer bears the additional costs.
5.3 For business customers, risk transfers upon handover to the shipping company.
5.4 If goods are unavailable, the Customer will be informed immediately.
5.5 In-store or local pickup is not possible.

6) Retention of Title
The goods remain the property of Amble Hound until payment has been made in full.

7) Warranty
7.1 Different warranty provisions apply to business customers.
7.2 Exceptions apply in cases of intent, injury to life, body, health, etc.
7.3 Rights of recourse remain unaffected.
7.4 Business customers must report defects without undue delay.
7.5 Consumers are encouraged, but not obligated, to report transport damage immediately.

8) Liability
8.1 Unlimited liability applies in cases of intent, gross negligence, injury to life, body, or health, and under product liability law.
8.2 In cases of slight negligence, liability applies only for breach of material contractual obligations.
8.3 Otherwise, liability is excluded.

9) Applicable Law
9.1 These Terms and any dispute arising out of or relating to them shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

9.2 This choice of law does not limit or exclude any mandatory consumer protection rights that may apply to customers under the laws of their state or country of residence.

10) Alternative Dispute Resolution
Amble Hound is not willing or obligated to participate in dispute resolution proceedings before a consumer arbitration board.
